2. Scope

This policy applies to the Windows desktop app “GIT-O-MATIK” (provided as MSIX via the Microsoft Store), to associated online services on mx-pro.de (e.g., license and update servers)
as well as to the Alexa skill “Click-O-MATIK” (metronome skill for Amazon Alexa).

3. Categories of Data Processed

  • Usage and License Data: License key, name, email, optional device/installation ID for license verification, version statuses of App/Core/Assets.
  • Technical Data: Operating system/version information, timestamps, local log entries (error reports/crash logs only with your explicit consent).
  • Audio Signals: Microphone input for pitch/timing analysis exclusively local; no transmission to us.
  • Network Data: IP address, time, URL, and headers for license/update queries.

4. Purposes of Processing

  • License Management (purchase confirmation, activation/verification, abuse prevention).
  • Update Check & Asset Download (retrieval of new assets into a writable user folder).
  • Operation & Security (error diagnosis, stability; voluntary crash logs only with consent).
  • Contract & Support (fulfillment of the user agreement, answering inquiries).

5. Legal Bases

  • Art. 6 para. 1 lit. b GDPR (contract/pre-contractual measures): License verification, provision of updates.
  • Art. 6 para. 1 lit. f GDPR (legitimate interest): Abuse prevention, security, minimal logging.
  • Art. 6 para. 1 lit. a GDPR (consent): optional error reports/crash logs, newsletter (if offered).

6. Sources & Recipients

  • Microsoft Store (MSIX): Provision, installation, and automatic updates are handled by Microsoft. Microsoft processes Store/account data under its own responsibility.
  • mx-pro.de (WooCommerce): Purchase processing and license management (name, email, billing data) based on Art. 6 para. 1 lit. b GDPR.
  • Payment Service Providers: e.g., Stripe/PayPal. Payment data is processed directly by them; their privacy policies apply.
  • Hosting/IT Service Providers: for operating the website and the license/update server (processor according to Art. 28 GDPR).

7. Data Flows in the App

  • Audio: Microphone access exclusively local; no transmission.
  • Update/Assets: Retrieval of a manifest from updates.mx-pro.de. New assets are stored in %LOCALAPPDATA%\GIT-O-MATIK\assets.
  • Binaries (EXE/DLL): are not replaced within the app; updates exclusively via the Store (MSIX).

7a. Use of the Alexa Skill “Click-O-MATIK” (Amazon Alexa)

The Alexa skill “Click-O-MATIK” is a free metronome skill for Amazon Alexa-enabled devices
(e.g., Echo, Echo Show). The skill runs in Amazon’s Alexa environment;
voice recordings, speech recognition, and your Amazon account are processed by Amazon under its own responsibility.
Amazon’s privacy and terms of use apply (in particular “Alexa and Alexa Devices”).

What data we receive via the skill

When you use the skill, Amazon transmits, among other things, within the Alexa interface:

  • a pseudonymous user or device ID (no name, no email address),
  • the respective request as a structure (Intent, e.g., Start/Stop, Tempo, Time Signature),
  • technical information about the language/region (Locale) and the device’s capabilities
    (e.g., whether a display is present).

We use this information exclusively to fulfill your request
(e.g., start metronome, set tempo/time signature, display interface) and generate an appropriate response.
We do not permanently store this data in our own database and do not combine it with other
personal data. No profiling takes place.

Retrieval of Audio Loops and Graphics from Our Servers

For the skill to function, your Alexa device downloads metronome loops (audio files) and steampunk graphics
from our servers (mx-pro.de / updates.mx-pro.de). As with any website access,
server-side log data (“server logs”) is generated, e.g.:

  • IP address of the requesting device,
  • date and time of retrieval,
  • retrieved URL and HTTP status code,
  • amount of data transferred,
  • if applicable, user-agent/technical client information.

This processing is technically necessary to provide the skill and the associated files.
The legal basis is Art. 6 para. 1 lit. f GDPR (legitimate interest in the secure, stable operation
of our online services). The log data is only retained for the purposes described under point 8 (“Storage Duration”)
(operation, security, error analysis) and within the periods mentioned there.

Advertising for the Desktop App “GIT-O-MATIK”

The skill can verbally and – on devices with a screen – graphically refer to our desktop software
“GIT-O-MATIK” and display links to our websites. No additional
personal data is processed in this context; it is merely a reference to a separate offering.
For the use of the website or the desktop app, the privacy notices described there apply.

Legal Bases

Insofar as we process personal or personally identifiable data in connection with the skill
(e.g., IP addresses in server logs, pseudonymous device IDs in requests), this occurs

based on our legitimate interest in the secure, stable operation of the skill
and our servers (Art. 6 para. 1 lit. f GDPR).

8. Storage Duration

License data for the duration of the license and according to legal retention requirements. Support correspondence until completion or according to commercial/tax law provisions. Technical logs (including server logs when retrieving audio loops and graphics by the Alexa skill) only as long as necessary; crash logs only with consent.

9. Third-Country Transfers

Transfers to third countries only occur if necessary, with consent, or based on appropriate safeguards (Art. 44 et seq. GDPR), e.g., standard contractual clauses.

10. Security

TLS-secured connections, hardened servers, least privilege principle, regular updates. The app uses the Windows App Container (MSIX); write access occurs in user paths.

11. Your Rights

You have rights to information, rectification, erasure, restriction of processing, data portability, and objection to processing under Art. 6 para. 1 lit. f GDPR. Consents can be revoked with future effect. Contact: see Controller. Furthermore, there is a right to lodge a complaint with a supervisory authority.

12. Children/Adolescents

Our offering is not directed at children under 16 years of age.

13. Cookies/Tracking

The app does not set cookies and does not use third-party tracking. Cookies/analysis tools may be used on the website mx-pro.de (see the privacy policy there).

14. Changes to this Policy

We will adapt this policy if legal situations, services, or processing activities change. The current version is available at https://mx-pro.de/datenschutz-git-o-matik.
