1. Scope and Acceptance
This End-User License Agreement ("EULA") is a legally binding agreement between you and mx-pro Joerg Klein ("Licensor") regarding the use of GIT-O-MATIK ("Software").
By installing or using the Software, you agree to the terms of this EULA.
If you obtained the Software through the Microsoft Store or another app store, the respective store's terms may also apply. In case of a conflict, the terms of the respective store apply to purchase, billing, and refunds; this EULA governs the use of the Software.
2. Grant of License
Subject to this EULA and, if applicable, the payment of the corresponding license fee, the Licensor grants you a limited, non-exclusive, non-transferable, and revocable right to install and use the Software for your own purposes on up to one (1) device per license.
All rights not expressly granted are reserved by mx-pro Joerg Klein.
3. Trial Version
If you are using a trial version, it is limited to 21 days and may contain functional restrictions.
After the trial period expires, the Software or individual functions may no longer be available unless a valid paid license is activated.
4. Activation and License Key
An internet connection and a valid license key may be required for activation.
License keys may not be shared. Activation mechanisms or other license restrictions may not be circumvented or attempted to be circumvented.
mx-pro Joerg Klein may suspend or terminate licenses in case of misuse, unauthorized sharing, or other material breaches of this EULA.
5. Updates and Changes
mx-pro Joerg Klein may provide updates, including bug fixes, compatibility updates, security patches, and new features.
Features, user interfaces, and technical requirements may change between different versions.
Major upgrades may be subject to separate license terms or additional fees.
6. Software Functions and Audio Processing
GIT-O-MATIK includes tools for guitar practice, audio processing, and analysis.
Depending on the installed version, these may include functions such as metronome, tuner, timing analysis, audio monitoring, processing of cabinet impulse responses, audio playback, looping, and playback speed adjustment.
The Cab-O-Matic function can process audio signals in real-time using speaker impulse responses ("IRs").
The Play-O-Matic function can play compatible audio files and provide features such as manual looping and playback speed adjustment.
Results from audio analysis, tuning, timing, or signal processing serve as practice and creative tools and do not represent scientifically or technically calibrated measurements.
7. Audio Hardware and Safety with Guitar Amplifiers
You are solely responsible for using appropriate audio equipment and signal levels when connecting amplifiers, preamplifiers, audio interfaces, speakers, or other devices to GIT-O-MATIK.
Never connect the speaker output of a guitar amplifier directly to the input of a standard audio interface.
Speaker outputs can carry high power and damage audio interfaces, computers, or other devices.
Only use outputs explicitly designed for connection to line or instrument levels, such as suitable line-out, preamp-out, FX-send, or other manufacturer-approved outputs.
When using tube amplifiers, always observe the amplifier manufacturer's specifications regarding speaker loads, load boxes, and connected speaker cabinets.
mx-pro Joerg Klein assumes no liability for damages resulting from incorrect wiring, unsuitable signal levels, improper loading of an amplifier, or use contrary to manufacturer specifications.
8. Permitted Use and Restrictions
You may not:
- rent, lease, resell, or host the Software for third parties;
- remove or alter proprietary or copyright notices;
- use for the development of malware or for unlawful purposes;
- reverse engineer, decompile, or disassemble, unless expressly permitted by mandatory legal provisions, particularly insofar as this is legally permitted for the purpose of achieving interoperability;
- circumvent or attempt to circumvent license or activation mechanisms.
9. Third-Party Components and Open-Source Software
The Software contains third-party software components that are subject to their respective license terms.
A list of the third-party components used and the associated license information can be found in the file THIRD-PARTY-NOTICES.txt supplied with the Software.
Insofar as a third-party or open-source license grants you further rights for the respective component, these license terms shall prevail for that component.
10. User-Loaded Audio Files and Impulse Responses
GIT-O-MATIK may allow the loading of external audio files and impulse response files.
You are solely responsible for ensuring that you have the necessary rights to use these files.
mx-pro Joerg Klein claims no ownership rights to user-loaded audio files or impulse responses.
Compatibility with all third-party audio files, impulse responses, audio interfaces, amplifiers, or operating system configurations cannot be guaranteed.
11. Data and Privacy
The Software may locally store information necessary for its operation, such as configuration settings, application settings, and license information.
Insofar as an internet connection is required for license verification, activation, update checks, or other expressly designated online functions, only the information necessary for the respective function will be transmitted.

12. Disclaimer of Warranty
To the extent permitted by law, the Software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
Compatibility with all third-party hardware configurations, audio drivers, operating systems, amplifiers, audio interfaces, or file formats cannot be guaranteed.
Mandatory statutory consumer rights remain unaffected by this.
13. Limitation of Liability
To the extent permitted by law, mx-pro Joerg Klein shall not be liable for indirect, incidental, special, or consequential damages, including lost profits, loss of data, or lost business opportunities.
Total liability is, to the extent permitted by law, limited to the amount actually paid for the respective software license.
This EULA does not exclude or limit liability where such exclusion or limitation is prohibited by law. This applies in particular to liability for intent, gross negligence, fraud, and injury to life, body, or health, as applicable.
14. Termination
This EULA will automatically terminate if you materially breach its terms.
Upon termination, you must cease using the Software and uninstall it.
Provisions that by their nature are intended to survive termination shall remain in effect.
15. Export and Sanctions Regulations
You must comply with all applicable export control and sanctions regulations and may not use or distribute the Software where prohibited by applicable law.
16. Governing Law and Jurisdiction
This EULA is governed by the laws of the Federal Republic of Germany, excluding its conflict of laws principles.
If you are a consumer, mandatory consumer protection regulations of your country of residence remain unaffected.
For commercial users, Ingolstadt shall be the exclusive place of jurisdiction, to the extent permitted by law.
For consumers, the statutory rules of jurisdiction apply.
17. App Store Terms
If the Software was obtained through an App Store, purchase, billing, and refunds are governed by the terms of the respective store.
This EULA governs the licensing, permitted use, and use restrictions of the Software itself.
18. Miscellaneous Provisions
This EULA constitutes the agreement between you and mx-pro Joerg Klein regarding the subject matter hereof.
Should any provision be invalid or unenforceable, the remaining provisions shall remain unaffected.
Failure to enforce a provision does not constitute a waiver of its enforcement.
The Licensor may assign this EULA in connection with a merger, acquisition, reorganization, or sale of material business assets.
