Scope<\/h2>\n\n<p class=\"wp-block-paragraph\">This policy applies to the Windows desktop app &#8220;GIT-O-MATIK&#8221; (provided as MSIX via the Microsoft Store), to associated online services on mx-pro.de (e.g., license and update servers)<br\/>as well as to the Alexa skill &#8220;Click-O-MATIK&#8221; (metronome skill for Amazon Alexa).<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"kategorien\">3. Categories of Data Processed<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Usage and License Data:<\/strong> License key, name, email, optional device\/installation ID for license verification, version statuses of App\/Core\/Assets.<\/li>\n\n\n\n<li><strong>Technical Data:<\/strong> Operating system\/version information, timestamps, local log entries (error reports\/crash logs only with your explicit consent).<\/li>\n\n\n\n<li><strong>Audio Signals:<\/strong> Microphone input for pitch\/timing analysis exclusively local; no transmission to us.<\/li>\n\n\n\n<li><strong>Network Data:<\/strong> IP address, time, URL, and headers for license\/update queries.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"zwecke\">4. Purposes of Processing<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>License Management<\/strong> (purchase confirmation, activation\/verification, abuse prevention).<\/li>\n\n\n\n<li><strong>Update Check &amp; Asset Download<\/strong> (retrieval of new assets into a writable user folder).<\/li>\n\n\n\n<li><strong>Operation &amp; Security<\/strong> (error diagnosis, stability; voluntary crash logs only with consent).<\/li>\n\n\n\n<li><strong>Contract &amp; Support<\/strong> (fulfillment of the user agreement, answering inquiries).<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"rechtsgrundlagen\">5. Legal Bases<\/h2>\n\n<ul class=\"wp-block-list\">\n<li>Art. 6 para. 1 lit. <strong>b<\/strong> GDPR (contract\/pre-contractual measures): License verification, provision of updates. <\/li>\n\n\n\n<li>Art. 6 para. 1 lit. <strong>f<\/strong> GDPR (legitimate interest): Abuse prevention, security, minimal logging. <\/li>\n\n\n\n<li>Art. 6 para. 1 lit. <strong>a<\/strong> GDPR (consent): optional error reports\/crash logs, newsletter (if offered). <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"empfaenger\">6. Sources &amp; Recipients<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Microsoft Store (MSIX):<\/strong> Provision, installation, and automatic updates are handled by Microsoft. Microsoft processes Store\/account data under its own responsibility. <\/li>\n\n\n\n<li><strong>mx-pro.de (WooCommerce):<\/strong> Purchase processing and license management (name, email, billing data) based on Art. 6 para. 1 lit. b GDPR.  <\/li>\n\n\n\n<li><strong>Payment Service Providers:<\/strong> e.g., Stripe\/PayPal. Payment data is processed directly by them; their privacy policies apply. <\/li>\n\n\n\n<li><strong>Hosting\/IT Service Providers:<\/strong> for operating the website and the license\/update server (processor according to Art. 28 GDPR).<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"datenfluesse\">7. Data Flows in the App<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Audio:<\/strong> Microphone access exclusively local; no transmission.<\/li>\n\n\n\n<li><strong>Update\/Assets:<\/strong> Retrieval of a manifest from <code>updates.mx-pro.de<\/code>. New assets are stored in <code>%LOCALAPPDATA%\\GIT-O-MATIK\\assets<\/code>. <\/li>\n\n\n\n<li><strong>Binaries (EXE\/DLL):<\/strong> are not replaced within the app; updates exclusively via the Store (MSIX).<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>7a. Use of the Alexa Skill &#8220;Click-O-MATIK&#8221; (Amazon Alexa) <\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The Alexa skill &#8220;Click-O-MATIK&#8221; is a free metronome skill for Amazon Alexa-enabled devices<br\/>(e.g., Echo, Echo Show). The skill runs in Amazon&#8217;s Alexa environment;<br\/>voice recordings, speech recognition, and your Amazon account are processed by Amazon under its own responsibility.<br\/>Amazon&#8217;s privacy and terms of use apply (in particular &#8220;Alexa and Alexa Devices&#8221;). <\/p>\n\n<h3 class=\"wp-block-heading\">What data we receive via the skill<\/h3>\n\n<p class=\"wp-block-paragraph\">When you use the skill, Amazon transmits, among other things, within the Alexa interface:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>a pseudonymous user or device ID (no name, no email address),<\/li>\n\n\n\n<li>the respective request as a structure (Intent, e.g., Start\/Stop, Tempo, Time Signature),<\/li>\n\n\n\n<li>technical information about the language\/region (Locale) and the device&#8217;s capabilities<br\/>(e.g., whether a display is present).<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">We use this information exclusively to fulfill your request<br\/>(e.g., start metronome, set tempo\/time signature, display interface) and generate an appropriate response.<br\/>We do not permanently store this data in our own database and do not combine it with other<br\/>personal data. No profiling takes place. <\/p>\n\n<h3 class=\"wp-block-heading\">Retrieval of Audio Loops and Graphics from Our Servers<\/h3>\n\n<p class=\"wp-block-paragraph\">For the skill to function, your Alexa device downloads metronome loops (audio files) and steampunk graphics<br\/>from our servers (mx-pro.de \/ updates.mx-pro.de). As with any website access,<br\/>server-side log data (&#8220;server logs&#8221;) is generated, e.g.: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>IP address of the requesting device,<\/li>\n\n\n\n<li>date and time of retrieval,<\/li>\n\n\n\n<li>retrieved URL and HTTP status code,<\/li>\n\n\n\n<li>amount of data transferred,<\/li>\n\n\n\n<li>if applicable, user-agent\/technical client information.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">This processing is technically necessary to provide the skill and the associated files.<br\/>The legal basis is Art. 6 para. 1 lit. f GDPR (legitimate interest in the secure, stable operation<br\/>of our online services). The log data is only retained for the purposes described under point 8 (&#8220;Storage Duration&#8221;)<br\/>(operation, security, error analysis) and within the periods mentioned there.   <\/p>\n\n<h3 class=\"wp-block-heading\">Advertising for the Desktop App &#8220;GIT-O-MATIK&#8221;<\/h3>\n\n<p class=\"wp-block-paragraph\">The skill can verbally and \u2013 on devices with a screen \u2013 graphically refer to our desktop software<br\/>&#8220;GIT-O-MATIK&#8221; and display links to our websites. No additional<br\/>personal data is processed in this context; it is merely a reference to a separate offering.<br\/>For the use of the website or the desktop app, the privacy notices described there apply. <\/p>\n\n<h3 class=\"wp-block-heading\">Legal Bases<\/h3>\n\n<p class=\"wp-block-paragraph\">Insofar as we process personal or personally identifiable data in connection with the skill<br\/>(e.g., IP addresses in server logs, pseudonymous device IDs in requests), this occurs<\/p>\n\n<p class=\"wp-block-paragraph\">based on our legitimate interest in the secure, stable operation of the skill<br\/>and our servers (Art. 6 para. 1 lit. f GDPR).<\/p>\n\n<p class=\"wp-block-paragraph\">for the provision of the skill and processing of your requests<br\/>(Art. 6 para. 1 lit. b GDPR \u2013 contract\/similar user relationship) and<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"speicherdauer\">8. Storage Duration<\/h2>\n\n<p class=\"wp-block-paragraph\">License data for the duration of the license and according to legal retention requirements. Support correspondence until completion or according to commercial\/tax law provisions. Technical logs (including server logs when retrieving audio loops and graphics by the Alexa skill) only as long as necessary; crash logs only with consent.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"drittland\">9. Third-Country Transfers<\/h2>\n\n<p class=\"wp-block-paragraph\">Transfers to third countries only occur if necessary, with consent, or based on appropriate safeguards (Art. 44 et seq. GDPR), e.g., standard contractual clauses.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"sicherheit\">10. Security<\/h2>\n\n<p class=\"wp-block-paragraph\">TLS-secured connections, hardened servers, least privilege principle, regular updates. The app uses the Windows App Container (MSIX); write access occurs in user paths. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"rechte\">11. Your Rights<\/h2>\n\n<p class=\"wp-block-paragraph\">You have rights to information, rectification, erasure, restriction of processing, data portability, and objection to processing under Art. 6 para. 1 lit. f GDPR. Consents can be revoked with future effect. Contact: see Controller. Furthermore, there is a right to lodge a complaint with a supervisory authority.     <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"kinder\">12. Children\/Adolescents<\/h2>\n\n<p class=\"wp-block-paragraph\">Our offering is not directed at children under 16 years of age.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"cookies\">13. Cookies\/Tracking<\/h2>\n\n<p class=\"wp-block-paragraph\">The app does not set cookies and does not use third-party tracking. Cookies\/analysis tools may be used on the website <a href=\"https:\/\/mx-pro.de\/en\/\" target=\"_blank\" rel=\"noopener\">mx-pro.de<\/a> (see the privacy policy there). <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"aenderungen\">14. Changes to this Policy<\/h2>\n\n<p class=\"wp-block-paragraph\">We will adapt this policy if legal situations, services, or processing activities change.
